NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders.The following are terms you agree to when commissioning me. My terms of service applies to any work I make, from customs to adopts and commissions. These terms are non-negotiable and by commissioning the Client automatically agrees to having read them and agrees to follow them upon buying from me.
Payment up front for orders below $100 within 24 hours.
All payments must be in USD.
Product will be delivered digitally.
Seller will not be responsible for loss of product once it has been delivered and/or shipped.
Customer has right to one complete revision in the sketching phase.
Customer has right to reasonable amounts of minor edits after completion (I.E eyecolour change).
Customer is required to contact the seller in a fast and responsive manner.
Artwork requires 2 weeks minimum, and may take up to 3 months depending on each project. This does not include shipping times for physical artwork.
Commissions do not have a set turnaround time, unless a date to finish the commission is agreed upon by both the Artist and the Client.
No refunds are possible after work begins unless initiated by the Artist.
Customers may not file chargebacks against the Artist.
Clients have the right to request refunds after 3 months if the commission has not been delivered, progress has not been made, and there was no agreed upon amendment to the timeline.
Products cannot be used for commercial use without additional fees.
Any breach of the Terms of Service by Customer means the Customer has forfeited any products to the Artist and the Artist may repurpose products as they wish.
Seller can cancel and refund any order at any time.
Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.

LAST UPDATE: 02/23/2025Before starting a project, we need to make sure we are on the same page so there aren't misunderstandings and to protect against fraud, so please take some time to read through these terms! Thank you.The following are terms you agree to when commissioning me. My terms of service applies to any work I make, from customs to adopts and commissions. These terms are non-negotiable and by commissioning the Client automatically agrees to having read them and agrees to follow them upon buying from me.This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:
1. ENGAGEMENT
a. Client provides clear and complete requirements and expectations upfront, including reference materials or assets before Work begins.
b. Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the Work.
c. Client warrants that the character design, reference material and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client.
d. Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.
e. Artist strives to perform to the best of their ability in good faith and warrants Work is 100% original according to Artist’s best knowledge.
f. Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.
g. Artist warrants that they will not copy or heavily reference unauthorized materials.
h. Artist reserves the right to refuse projects or requests based on content, subject, or other reasons, without explanation.
i. Artist reserves the right to cancel projects or requests based on content, subject, or other reasons, without explanation.
j. Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Toyhouse, Google document, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.
2. CONTENT ALLOWANCE
a. Artist is willing to create content featuring the following:
i. Subjects:
1. Humans (including characters with some non-human features)
2. Kemonomimi (characters with animal features)
3. Monsters (characters with monstrous/non-human qualities)
4. Anthropomorphic characters (fully animalistic characters walking upright and potentially with human-like qualities)
5. Feral characters (Characters that are completely animalistic, walk on all fours)
ii. Characters:
1. Original Characters (OCs) you/others designed
2. Fan Characters (FCs) based on existing fictional universes
3. Sonas (characters that represent you)
iii. Content Types:
1. Fanart of existing characters
2. Pin-up art or nudity (tastefully done, with no explicit content, requires age verification for nudity)
3. Light Gore (violence depicted in a non-gratuitous way)
4. Candy Gore (stylized and non-realistic depiction of violence)
5. Multiple characters (compositions featuring several characters)
6. Implied Sexual Content (sensuality suggested but not explicitly shown)
7. Explicit Sexual Content (strong sexual themes, requires age verification for 18+)
iv. Character Age and Relationships:
1. Young adults (18 - 35 years old)
2. Middle-aged adults (36 - 55 years old)
3. Elderly-appearing characters (56+ years old)
4. Couples of any kind, regardless of sexual orientation or gender identities:
a. Canon x Canon (characters from the same fictional universe)
b. Canon x OC (an original character with a character from a fictional universe)
c. OC x OC (two original characters)
d. Male/Female couples (MxF)
e. Male/Male couples (MxM)
f. Female/Female couples (FxF)
3. CONTENT RESTRICTIONS
a. Artist will not create content that is explicit, discriminatory, offensive, or inappropriate.
b. Artist will not create any sexually explicit content for Clients under the age of 18. Clients must be 18 or order to request content. If the Artist has any reason to suspect the Client is underage while asking for an NSFW commission, the Work will be automatically rejected/canceled, and the Artist will cease future communications and business with the Client.
c. Specific restrictions include but are not limited to underage characters, mature/explicit content without age verification, complex mech/machinery hate or discriminatory art, excessive muscles, copied styles, cultures the Artist may not be able to portray authentically, pedophilic relations, incestuous relations, heavy gore, overly complex designs, or certain kinks/fetishes (i.e, watersports, DDLG, cub, diapers, babyfurs); the Client is asked to confirm with the Artist beforehand if a certain kink/fetish or design complexity is acceptable.
d. Artist will not create material for the intended usage of any form of Artificial Intelligence (AI), AI datasets or for AI tools, replication or tracing, Non-Fungible Tokens (NFTs), or cryptocurrency in any present or future inventions in the space.
4. TIMELINE AND PROCESS
a. Work completion requires 2 weeks minimum, and may take up to 3 months depending on each project.
b. Commissions do not have a set turnaround time, unless a date to finish the commission is agreed upon by both the Artist and the Client. Refer to section 8.h. for additional fees regarding deadlines.
c. Timeline depends on commission type, complexity, and workload.
d. The Artist does not work on a "first come first serve" basis. Smaller commissions/commissions that do not take much time may be worked on in between larger commissions/commissions requiring more time.
e. Client should plan launches and streams accordingly.
f. Artist provides progress updates and seeks Client feedback voluntarily.
g. Final deliverables are provided by the Artist using private messages such as Discord or Toyhouse, email, Google Drive or similar file transfer tools, in PNG/JPEG formats as applicable. Additional file formats will incur a $10 fee per each type requested (i.e, PSD, TIFF). Any files hosted by the Artist will be available for the Client to download for 30 days.
h. If there are any delays and adjustments to timeline, the Artist will inform the Client.
i. Clients must first agree to delays and amendments to timeline exceeding 3 months through standard communication channels.
j. Clients have the right to request refunds 3 months after deadlines according to 9.e, if Work has not been delivered and there was no agreed upon amendment to the timeline.
5. REVISIONS
a. One free revision is allowed per item shown to the Client during the process.
i. After lining process, only minor revisions are allowed.
b. Additional charges for excessive revisions may be required.
i. Redraws or large edits will incur full commission price of the original piece quoted to the Client.
ii. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/correspondence while the commission was still in the sketching/lineart stage.
c. Revisions may affect progress and timeline.
d. Clients may not edit the work after final delivery unless specified in the commission information, project outlines or otherwise approved by the Artist.
e. Final products are only subject to small revisions, and unless otherwise stated by the Artist, refunds are not available after a piece is finished and received by the Client.
6. COMMUNICATION
a. Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
b. Client agrees to provide timely responses to inquiries, requests for feedback, or approval of drafts to ensure the smooth progression of the project. Delays in communication may result in adjusted deadlines.
c. Communication channels may include a dedicated commission Discord server, Discord direct messages, Toyhouse private messages, Trello, email, or other social medias according to Artist discretion.
d. Artist response time may vary, up to 3 days in order to provide better or more concrete updates.
e. The Artist and Client agree to discuss relevant matters concerning the project. Both parties have the right to decline other topics of discussion.
f. Client agrees to respect the agreed-upon scope of work as outlined in the project proposal or contract. Requests for additional work, revisions beyond the agreed limit, or significant changes may incur additional fees, which will be communicated clearly in advance.
g. Client agrees to communicate in a professional and courteous manner at all times. Harassment, abusive language, discriminatory behavior, or any form of hostility will not be tolerated.
h. The Artist reserves the right to terminate the project immediately if the Client engages in inappropriate, abusive, or unethical behavior. In such cases, the Artist retains ownership of all completed and incomplete work, and any payments made up to the termination point will not be refunded.
7. RIGHTS & USAGE
a. Artist General Rights
i. By default, Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications.
ii. The Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.
1. Including, but not limited to, full resale of aborted Work to potential Clients, utilizing for YCHs (Your Character Here), character designs, adoptables, etc.
iii. The Artist retains the non exclusive rights to sell merchandise and prints of their Work, unless exclusive commercial rights are purchased by the Client.
iv. Works that the Artist has created for Clients will be posted publicly on social medias as promotional material, or on the Artist’s commission site as an example. No commission is exempt from this; unless otherwise discussed with the Client ahead of time or due to effectively signed NDA by Artist.
1. Privacy fees may be applied to order total as it affects the Artist’s promotional material they can use publicly. Privacy fees are $10 per post.
b. Client Rights for Personal Use Licensed Works
i. Clients receive non-transferable usage rights to the Work for personal use. Refer to Section 7.c. for commercial rights.
ii. Personal use means: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the Work is involved.
iii. Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on where possible.
iv. If Clients are found to be reposting or using the Artist’s Work without credit and permission, the Artist will refuse further commissions and/or general business with Client in the future.
V. Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFTs (Non-Fungible tokens); blockchain; cryptocurrency; or other for-profit platforms/purposes, is strictly prohibited, including for personal usage, for present and future inventions in the space.
c. Client Rights for Commercial Use Licensed Works
i. Commercial usage rights are not included in general commissions, unless specified in the commission type or project specifications listed on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth), or is purchased by the Client and agreed upon.
ii. Commercial rights may differ for each commission type. Commercial broadcast rights means usage of Work on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Work to another party, as a part of any product or merchandising, or on another platform.
iii. In the case of original design work and assets for the purpose and definition of the Client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively transferred to the Client for use, production and modification purposes, commercial or personal.
iv. Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFTs (Non-Fungible tokens); blockchain; cryptocurrency; or other for-profit platforms/purposes, is strictly prohibited, in any present or future inventions in the space.
v. Additional charges will be required for commercial usage if not included in the project type, listing, or specifications, typically 2x of the original cost.
d. Character Design Usage For Individuals
i. If Clients own any of the Artist’s designs, they agree to abide the Artist’s ToS; the Artist not responsible for those who are too ignorant to read it. Clients will be held responsible for breaking usage terms.
ii. The Client cannot apply their own rules/ToS to the Artist’s designs (i.e tradebacks).
iii. The Client may not sell any designs for more than the Client bought unless there has been purchased art for the design. Commissioned art adds to the monetary value of the design.
1. If a design was bought via any form of a trade/gift, they have no monetary value. Art trades, free art/requests, and art games do not add monetary value to the character.
2. Client cannot resell until art is added, if the design was traded/gifted.
iv. Artwork created by the Client can go towards the monetary value of the character, as long as it is within reason.
v. The Artist requires credit for the design for any usage. The Artist’s Works may be used as, but not limited to, icons, banners, website images, personal merchandise (i.e custom stickers, fursuits, pins), etc, as long as it is not for profit use with proper credit.
1. The Client is allowed to make personal merchandise of the Artist’s designs (that the Client owns) as long as the Client doesn’t claim to own/created the design (i.e pins, plushies, fursuits, etc). The Artist only asks for a commercial usage payment if the Client is directly using the Artist’s artwork for profit. See 7.c. for commercial usage rights.
vi. If Client wishes to have commercial usage rights to the design, the Client is required to discuss with the Artist before the purchase of a design to establish a commercial usage fee depending on the intended usage. See 7.c. for commercial usage rights.
vii. Client agrees to pay upfront, in full, for all Work within 24 hours; unless otherwise stated by the Artist.
viii. The Artists only allows holds of up to two weeks on adoptables/designs; unless otherwise discussed between the Client and the Artist.
xi. No refunds for adoptables/designs once they have been purchased. All sales are final, no exceptions.
x. The Artist has the right to resell a design the Client has rejected, not paid for and/or charged back on.
xi. The Client may make changes to the design; but not to the point where it is unrecognizable and/or not the Artist’s design anymore. Redesigns are fine unless it becomes unrecognizable from the original and the Artist is no longer given credit.
xii. If the Client backs out of purchases/ghost payment multiple times, the Client will be placed on the Artist’s blacklist unless the Client states a valid reason as to why the Client has to.
xiii. The Artist will revoke designs as needed due to chargebacks.
xiv. The Client may not resell or repost the Artist’s designs off-site, all designs should remain on Toyhouse.
xv. Client may not delete the Artist’s Work from Toyhouse. If the Client wishes to do so, please inform the Artist beforehand. If the design is given to someone without a Toyhouse, the Client must state the new owner’s name on the profile and keep it public.
1. Designs that are deleted from Toyhouse will be forfeited by the Client, and the Artist may reupload, resell, repurpose, etc, as they wish due to a breach of TOS.
2. The Artist can provide Toyhouse codes to the new owner for free, if asked.
8. PAYMENTS & FEES
a. Client pays in full up to $100 value, or pays a 50% downpayment for higher value projects.
i. In the case of projects above $100, the final 50% is due at first complete watermarked or low resolution preview of the final deliverables.
b. The Artist accept payment plans for larger commissions, but it must be fully paid off before the Artist will start; unless stated otherwise. Full refunds and partial refunds regarding payment plans are not accepted, no exceptions.
i. If the Client fails to adhere to the plan, the Artist will not refund if the Client fails to complete the full plan, for any reason.
ii. Payment plans will not exceed 30 days; unless otherwise explicitly agreed upon by the Artist and the Client.
iii. Holds are never guaranteed if the Client does not provide a date of payment plan expected.
c. Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.
d. Invoices and quotes must be paid upfront within 24 hours from initial correspondence/approval, or the project may be canceled.
e. Artist will not not start a commission until payment is received in full by the Client.
f. Prices are in USD, and paid via Cashapp, Stripe, PayPal, Ko-fi, or methods as provided by the Artist. Any other currency will not be accepted and the Client will have to pay the correct USD conversion rate.
g. Prices or fees may vary or change depending on complexity, requirements and/or additional requests.
i. The Artist reserves the right to add fees onto set prices as they see fit, including but not limited to additional revisions, rush fees, complexity prices, etc.
h. Rush fees apply if deadline is under 2 weeks or a certain timeframe. Client will be charged upwards to an additional $10-$30 depending on deadline.
i. Additionally, a fee of +10% of total order applies if deadlines are established after the initial order by the Client.
i. Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
j. Client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed.
9. CANCELLATION & REFUNDS
a. If Client requests cancellation, 50% of project fees may be forfeit if canceled within 2 weeks before work starts, or the Client will receive a partial refund or percentage off initial payment, depending on how much of the commission has been finished:
i. 100% refund if not started.
ii. 50% refunded if in the sketch stage.
iii. 25% refunded if in the lineart stage.
iv. No refund if in the base colors stage.
v. No refund if in the rendering stage.
vi. The Client will not receive any files of the commission.
b. No refunds are possible after work begins unless initiated by the Artist and except for circumstances due to the Artist as detailed in 9.e. and 4.j.
c. Artist will not provide refunds for prior finished work or for the finished product. Completion of a commission is final; unless revisions have been requested within reason or paid for in full.
d. The Client will not be refunded if they are unsatisfied with the commission.
i. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (i.e, adjusting colors), up to a maximum of two (2) times after correspondence. Any desired major revisions (i.e,. reposing, color scheme change, etc.) will be rejected.
e. If Artist cannot complete work or there are delays as detailed in Section 4 for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund according to the amount of work complete.
f. If the project is terminated due to Client misconduct, as outlined in section 6, no refunds will be issued, regardless of the work stage or payment amount. In such cases, the Artist retains ownership of all completed and incomplete work, and the Client forfeits all rights to the commission.
g. Client may not issue chargebacks against the Artist for any reason.
10. CONFIDENTIALITY
a. The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.
11. INDEMNIFICATION
a. Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.
b. If Client's rights and the terms of this agreement are violated or the Work is not delivered as agreed, due to Artist negligence, Artist will work to remedy the situation first according to the terms aforementioned and otherwise to the satisfaction of the Client.
12. ACCEPTANCE
a. Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
b. Agreement date is upon first inquiry/communication or first transaction, or by using a digital signature program for a more legally binding and enforceable agreement if the Artist does choose to.

By commissioning, you are confirming that you are 18 years or older, or have authorization from a guardian 18 years or older.
To commission any explicit or sexual content requires physical verification that you are 18 years or older.
Additional characters are half the base price. Max of 5.
Backgrounds are an additional +$10 (transparent, abstract/patterned, or colored are free).
Rush orders (orders that need to be done in less than four weeks) are an additional +$10-$30 depending on deadline.
Additional fees/changes in prices are possible depending on prompt/character/background/etc.
