NOTICE: This is the CONDENSED version of the TOS.
This summary is provided for convenience only and does not replace the full Terms of Service. The full TOS will apply to all orders.These Terms of Service (“Agreement”) apply to all work created by the Artist, including but not limited to commissions, customs, adopts, and designs. These terms are non-negotiable. By commissioning the Artist, the Client acknowledges that they have read, understood, and agreed to these terms.

  • Payment is required upfront for orders under $100 and must be completed within 24 hours.

  • All payments must be made in USD.

  • All products are delivered digitally unless otherwise stated.

  • The Artist is not responsible for loss of files after delivery or loss of product once it has been delivered and/or shipped.

  • Clients are entitled to one complete revision during the sketch phase.

  • Reasonable minor edits may be requested after completion (e.g., small color adjustments).

  • Clients must respond in a timely manner to communication requests.

  • Artwork requires a minimum of 2 weeks and may take up to 3 months depending on complexity and workload. This does not include shipping times for physical artwork.

  • Commissions have no guaranteed turnaround time unless explicitly agreed upon.

  • No refunds are available once work has begun, except in cases of extended delays as outlined below.

  • Clients may request a refund after 3 months if no meaningful progress has been made, no delivery has occurred, and no timeline extension was agreed upon.

  • Clients agree not to initiate chargebacks; doing so constitutes a breach of the Terms of Service.

  • Commercial usage rights are not included unless purchased separately.

  • Any breach of the Terms of Service may result in forfeiture of rights to the work, and the Artist retains ownership.

  • The Artist reserves the right to cancel and refund any order at their discretion.

  • Use of the work for AI, machine learning, NFTs, blockchain, cryptocurrency, or related technologies is strictly prohibited.

LAST UPDATE: 01/14/2026Before starting a project, we need to ensure that both parties are on the same page to prevent misunderstandings and protect against fraud. Please read these Terms of Service carefully.These Terms of Service (“Agreement”) apply to all work created by the Artist, including but not limited to commissions, customs, adopts, and designs. These terms are non-negotiable.This Agreement is entered into between the Artist and the Client for the commission of artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:

1. ENGAGEMENT
a. Client provides clear and complete requirements and expectations upfront, including reference materials or assets before Work begins.
b. Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the Work.
c. Client warrants that the character design, reference material and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client.
d. Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.
e. Artist strives to perform to the best of their ability in good faith and warrants Work is original according to Artist’s best knowledge.
f. Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.
g. Artist warrants that they will not copy or heavily reference unauthorized materials.
h. Artist reserves the right to refuse projects or requests based on content, subject, or other reasons, without explanation.
i. Artist reserves the right to cancel projects or requests based on content, subject, or other reasons, without explanation.
j. Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Toyhouse, Google document, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.

2. CONTENT ALLOWANCE
a. The Artist may accept commissions featuring the following, subject to discretion:
   i. Subjects:
     1. Humans (including characters with some non-human features)
     2. Kemonomimi (characters with animal features)
     3. Monsters (characters with monstrous/non-human qualities)
     4. Anthropomorphic characters (fully animalistic characters walking upright and potentially with human-like qualities)
     5. Feral characters (Characters that are completely animalistic, walk on all fours)
   ii. Characters:
     1. Original Characters (OCs) you/others designed
     2. Fan Characters (FCs) based on existing fictional universes
     3. Canon Characters (Characters in existing media)
     4. Sonas (characters that represent you)
   iii. Content Types:
     1. Fanart of existing characters
     2. Pin-up art or nudity (non-explicit; age verification required)
     3. Light Gore (violence depicted in a non-gratuitous way)
     4. Candy Gore (stylized and non-realistic depiction of violence)
     5. Multiple characters
     6. Implied Sexual Content (sensuality suggested but not explicitly shown)
     7. Explicit Sexual Content (18+ only; age verification required)
   iv. Character Age and Relationships:
     1. Young adults (18 - 35 years old)
     2. Middle-aged adults (36 - 55 years old)
     3. Elderly-appearing characters (56+ years old)
     4. All consensual adult pairings, regardless of sexual orientation or gender identities:
        a. Canon x Canon (characters from the same fictional universe)
        b. Canon x OC (an original character with a character from a fictional universe)
        c. OC x OC (two original characters)
        d. Male/Female couples (MxF)
        e. Male/Male couples (MxM)
        f. Female/Female couples (FxF)

3. CONTENT RESTRICTIONS
a. Artist will not create illegal, exploitative, hateful, or prohibited sexual content.
b. The Artist will not create sexually explicit content for anyone under 18. Any suspicion of underage involvement will result in immediate cancellation and termination of communication.
c. Prohibited content includes, but is not limited to:
   i. Underage characters in sexualized contexts
   ii. Pedophilic or incestuous themes
   iii. Heavy or realistic gore
   iv. Hate or discriminatory content
   v. Certain fetishes (e.g., watersports, DDLG, cub, diapers, babyfur)
   vi. Excessively complex designs or subjects the Artist cannot portray authentically
d. The Client should confirm with the Artist in advance whether any specific kink, fetish, or complex design request is acceptable before placing an order.
e. The Artist will not create Work intended for AI training, datasets, NFTs, blockchain, cryptocurrency, or similar technologies, present or future.

4. TIMELINE AND PROCESS
a. Completion requires a minimum of 2 weeks and may take up to 3 months depending on complexity and workload.
b. No guaranteed turnaround time exists unless explicitly agreed upon in writing. Refer to section 8.h. for additional fees related to deadlines or rush orders.
c. The Artist does not operate on a first-come, first-served basis. Smaller or less complex commissions may be worked on in between larger projects.
d. Clients are responsible for planning launches, streams, or related events accordingly and should not rely on estimated timelines unless formally agreed upon.
e. The Artist provides progress updates and may request Client feedback at their discretion.
f. Final deliverables are provided by the Artist using private messages such as Discord or Toyhouse, email, Google Drive or similar file transfer tools. Files are delivered in PNG format unless otherwise agreed. Additional file formats (e.g., PSD, TIFF) incur a $10 fee per format.
   i. Files hosted by the Artist will remain available for download for 30 days after delivery.
g. If there are any delays and adjustments to timeline, the Artist will inform the Client.
h. Any timeline extension exceeding three (3) months requires Client acknowledgment through standard communication channels.
i. Refund eligibility related to delays or non-delivery is governed exclusively by Section 9.
j. The Artist shall not be held liable for delays or inability to complete the Work due to circumstances beyond their reasonable control, including but not limited to illness, injury, family emergencies, natural disasters, power or internet outages, or platform failures. In such cases, timelines may be adjusted or refunds issued at the Artist’s discretion.

5. REVISIONS
a. One free revision is allowed during the sketch phase.
i. After lineart, only minor revisions are permitted.
b. Additional charges for excessive revisions may be required.
   i. Redraws or large edits will incur full commission price of the original piece quoted to the Client.
   ii. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/correspondence while the commission was still in the sketching/lineart stage.
   iii. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (i.e, adjusting colors), up to a maximum of two (2) times after correspondence. Any desired major revisions (i.e,. reposing, color scheme change, etc.) will be rejected.
c. Revisions may affect progress and timeline.
d. Clients may not alter, edit, modify, or manipulate the finished work after final delivery unless such edits were explicitly included in the commission terms, project outline, or approved in writing by the Artist.
e. Final products are only subject to small revisions, and unless otherwise stated by the Artist, refunds are not available after a piece is finished and received by the Client.

6. COMMUNICATION
a. Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
b. Client agrees to provide timely responses to inquiries, requests for feedback, or approval of drafts to ensure the smooth progression of the project. Delays in communication may result in adjusted deadlines.
c. The Client is required to respond to progress updates, requests for feedback, or approval within a reasonable timeframe. If the Client fails to respond for 14 consecutive days after a progress update or inquiry, the Artist reserves the right to pause the project until communication resumes.
d. If no response is received after 30 consecutive days, the project may be considered abandoned, and the Artist reserves the right to cancel the commission. In such cases, no refund will be issued, and the Artist retains ownership of all completed and incomplete work.
e. Communication channels may include a dedicated commission Discord server, Discord direct messages, Toyhouse private messages, Trello, email, or other social medias according to Artist discretion.
f. The Artist does not guarantee immediate responses and may take up to three (3) business days in order to provide accurate or substantive updates.
g. The Artist and Client agree to discuss relevant matters concerning the project. Both parties have the right to decline other topics of discussion.
h. Client agrees to respect the agreed-upon scope of work as outlined in the project proposal or contract. Requests for additional work, revisions beyond the agreed limit, or significant changes may incur additional fees, which will be communicated clearly in advance.
i. Client agrees to communicate in a professional and courteous manner at all times. Harassment, abusive language, discriminatory behavior, or any form of hostility will not be tolerated.
j. The Artist reserves the right to terminate the project immediately if the Client engages in inappropriate, abusive, or unethical behavior. In such cases, the Artist retains ownership of all completed and incomplete work, and any payments made up to the termination point will not be refunded.
k. Any commission canceled or abandoned due to Client non-responsiveness or breach of this Agreement remains the sole property of the Artist. The Client forfeits all rights to the Work, completed or incomplete.

7. RIGHTS & USAGE

a. Artist General Rights
   i. By default, Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications.
   ii. The Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.
     1. Including, but not limited to, full resale of aborted Work to potential Clients, utilizing for YCHs (Your Character Here), character designs, adoptables, etc.
   iii. The Artist retains the non exclusive rights to sell merchandise and prints of their Work, unless exclusive commercial rights are purchased by the Client.
   iv. Unless otherwise agreed upon in writing, the Artist retains the right to publicly display all commissioned works for promotional purposes, including but not limited to social media, portfolios, galleries, and commission or personal websites.
     1. No commission is exempt from public display unless explicitly discussed and agreed upon prior to payment or covered by a mutually agreed and signed Non-Disclosure Agreement (NDA).
     2. Clients who request privacy or delayed public posting acknowledge that this limits the Artist’s ability to use the work for promotion and may incur a privacy fee of $10 per post, added to the order total.
     3. Privacy fees apply per platform and per post unless otherwise agreed upon in writing.
   v. Failure to credit the Artist as required constitutes a breach of this Agreement and may result in revocation of usage rights.

b. Client Rights for Personal Use Licensed Works
   i. Clients receive non-transferable usage rights to the Work for personal use. Refer to Section 7.c. for commercial rights.
   ii. Personal use means: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the Work is involved.
   iii. Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on where possible.
   iv. If Clients are found to be reposting or using the Artist’s Work without credit and permission, the Artist will refuse further commissions and/or general business with Client in the future.
   v. Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFTs (Non-Fungible tokens); blockchain; cryptocurrency; or other for-profit platforms/purposes, is strictly prohibited, including for personal usage, for present and future inventions in the space.

c. Client Rights for Commercial Use Licensed Works
   i. Commercial usage rights are not included in general commissions, unless specified in the commission type or project specifications listed on the Artist’s websites (i.e. VTuber models, stream overlays, emotes, and so forth), or is purchased by the Client and agreed upon.
   ii. Commercial rights may differ for each commission type. Commercial broadcast rights means usage of Work on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Work to another party, as a part of any product or merchandising, or on another platform.
   iii. In the case of original design work and assets for the purpose and definition of the Client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively transferred to the Client for use, production and modification purposes, commercial or personal.
   iv. Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFTs (Non-Fungible tokens); blockchain; cryptocurrency; or other for-profit platforms/purposes, is strictly prohibited, in any present or future inventions in the space.
   v. Additional charges will be required for commercial usage if not included in the project type, listing, or specifications, typically 2x of the original cost.

d. Character Design Usage For Individuals
   i. If Clients own any of the Artist’s designs, they agree to abide the Artist’s ToS; Failure to read or understand these terms does not exempt the Client from compliance.
   ii. The Client may not impose their own rules or terms on the Artist’s designs (e.g., tradebacks or additional restrictions).
   iiii. The Client may not resell a design for more than the original purchase price unless additional commissioned artwork has been created for the design. Commissioned artwork adds to the design’s monetary value.
     1. Designs obtained through trades, gifts, free art, requests, or art games are considered to have no monetary value until additional artwork is added.
     2. Designs acquired via trade or gift may not be resold until paid artwork has been added.
   iv. Artwork created by the Client can go towards the monetary value of the character, as long as it is within reason.
   v. The Artist requires credit for the design in all forms of use. Designs may be used for personal purposes such as icons, banners, website images, and personal merchandise (e.g., custom stickers, fursuits, pins), provided the use is non-commercial and properly credited.
     1. The Client may create personal merchandise of designs they own, provided they do not claim authorship of the design. Commercial usage fees apply only when the Artist’s artwork itself is used for profit. See Section 7.c. for commercial usage rights.
   vi. If Client wishes to have commercial usage rights to the design, the Client is required to discuss with the Artist before the purchase of a design to establish a commercial usage fee depending on the intended usage. See Section 7.c. for commercial usage rights.
   vii. Full payment is required within 24 hours unless otherwise stated by the Artist.
   viii. Holds on adoptables or designs are limited to two (2) weeks unless otherwise agreed upon.
   xi. All adoptable and design sales are final. No refunds will be issued once purchased.
   x. The Artist reserves the right to resell any design that has been terminated, rejected, unpaid, or charged back.
   xi. The Client may modify or redesign a design they own, provided the design remains recognizable as the Artist’s work and proper credit is maintained.
   xii. Repeated failure to complete purchases, ghosting during payment, or repeated cancellations may result in the Client being blacklisted at the Artist’s discretion.
   xiii. Designs may be revoked by the Artist in cases of chargebacks or payment disputes.
   xiv. The Client may not resell or repost the Artist’s designs off-site. All designs must remain hosted on Toyhouse.
   xv. The Client may not delete the Artist’s work from Toyhouse without prior notice. If ownership is transferred to someone without a Toyhouse account, the Client must list the new owner’s name publicly on the profile.
     1. Designs removed from Toyhouse in violation of these terms will be considered forfeited, and the Artist may reupload, resell, or repurpose the design at their discretion.
     2. The Artist can provide Toyhouse codes to the new owner for free, if asked.

8. PAYMENTS & FEES
a. Full payment is required for orders under $100.
   i. In the case of projects above $100, the final 50% is due at first complete watermarked or low resolution preview of the final deliverables.
b. The Artist accept payment plans for larger commissions, but it must be fully paid off before the Artist will start; unless stated otherwise. Full refunds and partial refunds regarding payment plans are not accepted, no exceptions.
   i. If the Client fails to adhere to the plan, the Artist will not refund if the Client fails to complete the full plan, for any reason.
   ii. Payment plans will not exceed 30 days; unless otherwise explicitly agreed upon by the Artist and the Client.
   iii. Holds are never guaranteed if the Client does not provide a date of payment plan expected.
c. Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.
d. Invoices and quotes must be paid upfront within 24 hours from initial correspondence/approval, or the project may be canceled.
e. Artist will not not start a commission until payment is received in full by the Client.
f. No rights are transferred to the Client until full payment has been received.
g. Prices are in USD, and paid via Cashapp, Stripe, PayPal, Ko-fi, or methods as provided by the Artist. Any other currency will not be accepted and the Client will have to pay the correct USD conversion rate.
h. Prices or fees may vary or change depending on complexity, requirements and/or additional requests.
   i. The Artist reserves the right to add fees onto set prices as they see fit, including but not limited to additional revisions, rush fees, complexity prices, etc.
i. Rush fees apply if deadline is under 2 weeks or a certain timeframe. Client will be charged upwards to an additional $10-$30 depending on deadline.
   i. Additionally, a fee of +10% of total order applies if deadlines are established after the initial order by the Client.
j. Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
k. The Client agrees not to initiate chargebacks; doing so constitutes a breach of this Agreement.

9. CANCELLATION & REFUNDS
a. If Client requests cancellation, 50% of project fees may be forfeit if canceled within 2 weeks before work starts, or the Client will receive a partial refund or percentage off initial payment, depending on how much of the commission has been finished:
   i. 100% refund if not started.
   ii. 50% refunded if in the sketch stage.
   iii. 25% refunded if in the lineart stage.
   iv. No refund if in the base colors stage.
   v. No refund if in the rendering stage.
   vi. In all cases of cancellation, the Client will not receive any files, including sketches or WIPs, unless otherwise agreed by the Artist.
b. No refunds will be issued once work has begun, except when initiated by the Artist or under circumstances caused by the Artist as outlined in Section 9.
c. If the Artist cancels a commission for reasons within their control and no breach has occurred, the Client is eligible for a full or partial refund proportional to the amount of work completed, at the Artist’s discretion.
d. Artist will not provide refunds for prior finished work or for the finished product. Completion of a commission is final; unless revisions have been requested within reason or paid for in full.
e. The Client acknowledges that artistic style is subjective. Minor dissatisfaction or stylistic preference differences do not constitute grounds for refunds.
f. If no meaningful progress (such as sketches, lineart, base colors, or equivalent demonstrable work) or delivery has occurred after three (3) months, and no timeline extension was agreed upon in writing, the Client may submit a refund request in accordance with Section 9.a.
g. If the project is terminated due to Client misconduct, as outlined in Section 6, no refunds will be issued, regardless of the work stage or payment amount. In such cases, the Artist retains ownership of all completed and incomplete work, and the Client forfeits all rights to the commission.
h. Client unresponsiveness resulting in cancellation, as outlined in Section 6, does not qualify for a refund.

10. CONFIDENTIALITY
a. The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

11. INDEMNIFICATION
a. Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.
b. If Client's rights and the terms of this agreement are violated or the Work is not delivered as agreed, due to Artist negligence, Artist will work to remedy the situation first according to the terms aforementioned and otherwise to the satisfaction of the Client.

12. ACCEPTANCE
a. Client confirms they are 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
b. Agreement date is upon first inquiry/communication or first transaction, or by using a digital signature program for a more legally binding and enforceable agreement if the Artist does choose to.

13. RIGHT TO UPDATE TERMS OF SERVICE
a. The Artist reserves the right to update or modify these Terms of Service at any time. Updated terms will apply to future commissions or transactions only. Clients who have already placed or completed commissions under previous terms are bound by the Terms of Service in effect at the time of their order.

NOTE: Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.

  • By commissioning, you are confirming that you are 18 years or older, or have authorization from a guardian 18 years or older.

  • To commission any explicit or sexual content requires physical verification that you are 18 years or older.

  • Additional characters are half the base price. Max of 5.

  • Backgrounds are an additional +$10 (transparent, abstract/patterned, or colored are free).

  • Rush orders (orders that need to be done in less than four weeks) are an additional +$10-$30 depending on deadline.

  • Additional fees/changes in prices are possible depending on prompt/character/background/etc.
